Description

The subject of the contract is: Collection of waste at the Contracting Authority's facility at ul. Tarnowska 120, with the following codes: 20 01 08 – biodegradable kitchen waste, 20 02 01 – biodegradable waste and its management in the R3 process. Estimated amount of waste to be collected and processed: 6 000 [Mg]. The Contracting Authority reserves the right to specify that this amount of waste is an indicative amount and that the supply of waste in an amount less than 6 000 [Mg] does not give rise to any liability on the part of the Contracting Authority, with the reservation that the Contracting Authority is obliged to transfer to the Contractor for processing at least 1 500 [Mg] of waste, and for failure to transfer this minimum amount the Contracting Authority shall be liable for damages on the general principles provided for by generally applicable law. The minimum threshold of waste that the Contracting Authority will transfer to the Contractor for processing is 1 500 Mg. Waste will be loaded into containers owned by the Contractor using equipment provided by the Contracting Authority. After weighing on the Contracting Authority's weighbridge, the Contracting Authority will hand over the weighing ticket to the driver and issue a waste transfer note in the Database of Products and Packaging and Waste Management (BDO). Additional requirements of the Contracting Authority: 1. Waste collection will take place from Monday to Friday between 7.00 and 15.00. 2. The Contracting Authority informs that the submission of an offer does not have to be preceded by a site visit or verification of documents relating to the contract, which are at the disposal of the Contracting Authority and which will be made available to entities expressing interest in participating in the procedure. In order to arrange a site visit or familiarise oneself with the documentation available at the Contracting Authority's premises, please contact the persons designated for communication with the Contractors. 3. The Contractor will be obliged to provide the Contracting Authority with at least one KP 30 container for loading the transport for collection of green waste in an amount ensuring smooth collection of these wastes. The waste collection schedule will be sent by email for the following week, with the possibility of changing the number of trips with one day's notice. 4. The Contractor is obliged to adapt the transport vehicles with technical parameters enabling the unloading and loading of at least KP 30 type containers. 5. The subject of the contract shall be carried out in accordance with the applicable regulations in this respect, and in particular with: a) the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2026 item 1328), b) the Act of 27 April 2001 on environmental protection law (i.e. Journal of Laws of 2025 item 647, 1080, 1812, 1863, of 2026 item 176, 426, 605, 607, 635, 912, 982, 1157), c) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2025 item 733, of 2026 item 912). 6. The Contractor shall demonstrate that he has a legal title to the processing plant, at which the waste collected from the Contracting Authority will be subjected to the processing process in accordance with the applicable requirements in this respect. 7. The Contractor shall demonstrate that he has: - a valid decision to process waste with codes: 20 01 08 and 20 02 01 in the R3 process, in an amount of at least 6 000 Mg, - a permit issued by the Minister competent for agriculture to introduce fertiliser or a plant growth promoter into circulation and shall declare that the product, post-fermentation material or other material or substance, which is not waste, produced from the entire stream of green waste accepted for processing, has been introduced into circulation as organic fertiliser and/or a soil improver (Contractor's own declaration and permit without attachments). 8. The Contractor must have a policy or other current insurance document confirming that the Contractor is insured against civil liability in the scope of the conducted business activity in the amount of at least 1,000,000.00 (in words: one million zlotys) and is obliged to submit the current one in the event of expiry, so as to maintain the continuity of insurance without the need to call upon the Contracting Authority to supplement this document. 9. Settlement for waste processing for a given month will take place after the service is performed (within 5 working days after the end of the month), once a month on the basis of the Contracting Authority's weighing tickets consistent with the weights entered in the BDO system. The Contractor will present to the Contracting Authority, within 5 working days from the end of each calendar half-year (i.e. by 30.06.2027 and by 31.12.2027), information confirming the achievement of a 100% level of preparation for reuse and recycling in the R3 process. 10. Common Procurement Vocabulary (CPV): 90500000-2 waste-related services. 11. The Contracting Authority does not allow partial offers to be submitted. Division into parts would involve excessive technical difficulties and costs of contract performance and also the need to coordinate the actions of different Contractors implementing individual parts of the contract on a limited area. The Contracting Authority envisages the granting of contracts, as referred to in Article 214(1)(7) of the Public Procurement Law. The contract, which consists of the repetition of similar services, will be granted within 3 years from the date of the award of the main contract, in the event that there is a justified need to extend the main contract and the financial resources for this purpose are ensured. The scope of this contract is 20% of the main contract, i.e. it covers the processing of up to 1 200 Mg of waste. The contract will be awarded under a negotiated procedure, following negotiations with the Contractor.
