Description of the subject of the contract: 1. The subject of the contract are successive deliveries of light fuel oil to oil-fired boilers in the quantity of 598,000.00 l. A detailed description of the subject of the contract and the manner of its execution is contained in the OPZ, which is Annex No. 1 to the SWZ. 2. The subject of the contract has not been divided into parts. The contractor does not allow the submission of partial bids. 3. Definition of the subject of the contract using CPV codes: - 09135100-5 – Fuel oil 4. The contractor intends to use the so-called reverse procedure, as referred to in Article 139 of the PZP Act, i.e. the contractor will first carry out an examination and evaluation of the offers, and then carry out the qualification of the Contractor, whose offer was the highest rated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5. The contractor, pursuant to Article 441 of the PZP Act, intends to apply the right of option by submitting a unilateral written statement containing the quantities of fuel oil, the delivery of which is to take place within the right of option. A statement on the exercise of the right of option may be made no later than 5 days before the expiry of the contract period. The right of option consists in increasing the quantity of fuel oil ordered within the contract by a maximum of 30% of the remuneration of the Contractor specified in the contract on the date of submission of the statement on the exercise of the right of option. The entitlement referred to in the preceding sentence may be exercised repeatedly until the amount of 30% of the Contractor's remuneration on the date of submission of the statement is reached. Exercising the right of option results in an increase in the maximum remuneration of the Contractor specified in the contract. In the event of exercising the right of option, the provisions of the contract regarding prices apply directly to the increased scope of the order. A condition for exercising the right of option is the proper execution by the Contractor of the subject of this contract. The Contractor is not entitled to any claim in the event of the contractor not exercising the right of option. 6. Since the quantity of fuel oil depends on the current needs of the contractor, the contractor reserves the right that the quantity of fuels ordered in Annex No. 1 to the SWZ is an estimated quantity, which serves to properly evaluate the offers according to the criterion "price" 100%. This quantity may change – in accordance with the actual needs of the contractor and will not be the subject of any claims by the contractor. The contractor guarantees that the minimum value of the order awarded to the contractor will be 60% of the total remuneration specified in the contract.
