The present public procurement has as its subject the performance of the functions of a consultant/construction supervisor and an Engineer under the FIDIC Yellow Book Contract Conditions for the object: "Reconstruction and expansion of the internal water supply and sewerage networks in Gorna Oryahovitsa". SUBJECT OF THE CONTRACT

Engineer in the sense of Clause 3 from “General Conditions of Contract for Electrical and Mechanical Works and for Civil Engineering Works, for Design and Construction, and for Plant and Design-Build Contracts. General Conditions” International Federation of Consulting Engineers (FIDIC), 1st edition, 1999, Edition in Bulgarian translation: Bulgarian Association of Architects and Consulting Engineers, as well as the relevant Specific Conditions, as well as the Appendix to the tender offer under the engineering contract; Technical control in the design under the design and construction (engineering) contract by preparing a report/assessment of the compliance of the investment project for the above-mentioned object; Assessment of compliance in terms of Constructive in the sense of Art. 142, para. 10 of ZUT, where applicable; Construction supervision in the sense of Art. 168 of ZUT; Coordinator “safety and health” for the construction stage for the object, specified at the beginning of the present Specifications and in accordance with the conditions of the public procurement, specified in Section 1. The execution of the present contract is in accordance with the above. The contract covers the following services (which does not exclude the assignment of additional tasks in the process of executing the contract in accordance with specific needs and specifics):

Review, assessment of compliance with contractual requirements and approval of the Contractor's Program; Review, assessment of compliance with contractual requirements and approval of the revised (one or more) Contractor's Program; Control of the execution of the Contractor's Program; Review and opinion on the investment project prepared by the Contractor regarding its compliance with the Requirements of the Employer; Preparation of a comprehensive report on the assessment of the compliance of the investment project, as well as identical comprehensive reports in the course of the construction, incl. assessment of compliance in terms of "Constructive" in the sense of Art. 142, para. 10 of ZUT; Carrying out a documentary and physical check for compliance of the materials and equipment placed in the object up to the stage of their approval; Actions for the consideration and approval of the Contractor's insurances; Actions for the consideration and approval of the Contractor's guarantees, issued in connection with the performance of his contractual obligations; Actions for the issuance of decisions by the Engineer; Actions in case of unforeseen physical conditions established by the Contractor; Actions of the Engineer in case of non-performance by the Contractor of actions for environmental protection; Carrying out a documentary and physical check of the construction process; Issuance of acts for interim payments, incl. the actions preceding them; Actions of the Engineer related to change procedures; Actions of the Engineer in relation to claims in accordance with the contract with the Contractor; Control over the preparation of acts and protocols during construction; Organization and conduct of monthly progress meetings, incl. documentation of the results from them; Actions of the Engineer related to tests (individual and comprehensive – upon completion); Actions for the issuance of the Certificate of Acceptance of the Object; Actions for the issuance of the Certificate of Performance; Actions for the performance of the functions of a consultant/construction supervisor during the construction; Actions for the performance of the functions of the Coordinator for safety and health during the construction. The services specified above are not exhaustive, as the Engineer is also engaged with all other obligations that are not explicitly mentioned, but arise from the provisions of the present contract and the provisions of the General and Specific Conditions of the engineering contract, where the relationships Employer – Contractor – Engineer are described in detail and cannot be repeated here, without repeating the entire text of the contract conditions. For explicitly unregulated powers and competencies of the Contractor under the present contract in his capacity as an Engineer, the same exercises his functions as they arise from the specific contract conditions of the engineering contract with the Contractor in case they do not contradict the applicable legislation. The Contractor under the present contract must seek the written approval of the Employer before exercising his functions as an Engineer under FIDIC on the issues for which the sanction of the Employer is explicitly provided for in the clauses of the contract with the Contractor of the engineering contract.
