2. Division of the contract into lots

1) The contracting authority does not divide the contract into lots. Therefore, the contracting authority does not allow the submission of partial tenders, as referred to in Article 7(15) of the Pzp.

2) Reasons for not dividing: The subject of the contract is homogeneous and covers the purchase of electrical energy for the participants of the joint procedure, for a total of up to 1982 points of energy consumption (PPE), on equal price terms per 1 MWh for all tariffs. The contracting authority considered the possibility of dividing the contract, in particular according to individual entities, location, tariffs or groups of PPE, but considered such a division to be ineffective. The joint procedure serves to aggregate the demand of the participants and to utilise the scale of the contract in order to achieve the most favourable and uniform conditions for the purchase of energy. Division would lead to the dispersal of volume, could limit the economic benefits resulting from joint purchasing and cause diversification of trading conditions and increased contract management costs. The lack of division does not limit competition, as there are several sellers of electrical energy on the market with the potential to implement a contract covering the entire expected volume and all 1982 PPE. The scope of the contract does not require the implementation of various or specialist services. Taking into account the homogeneous nature of the subject of the contract, the purpose of joint purchasing, the benefits resulting from volume aggregation and the maintenance of real competition, the contracting authority considered that the non-division of the contract into lots is a rational, proportionate and economically justified solution.

The contracting authority does not allow the submission of variant offers.

4. Options

The contracting authority does not provide for the right of option.
