Poland – Specialist vehicles – Zakup pojazdu nieoznakowanego typu Furgon – Mobilne Laboratorium analityczne z zabudową w ramach projektu „NETFORCE-Network for Finansial Crimes Against European Union Enforcement”

The subject of the contract is the purchase and delivery of an unmarked vehicle type Van – Mobile Analytical Laboratory with a body in the framework of the project “NETFORCE-Network for Financial Crimes Against European Union Enforcement”. The technical parameters of the vehicle described in Annex No. 3 to the SWZ constitute the minimum requirements of the Purchaser. Failure to meet the minimum requirements will result in the rejection of the offer as non-compliant with the terms of the contract based on Article 226(1)(5) of the Pzp Act. The Purchaser requires the offered vehicle to be brand new, of category I, unused, unregistered, produced no earlier than in 2025, free from factory and legal defects, with a maximum mileage of no more than 100 km, roadworthy, meeting the quality and usability standards required by regulations and indicated by the Purchaser in Annex No. 3 to the SWZ. The Purchaser requires the Contractor to specify the make, model, version, symbol, or other additional data enabling the unique identification of the offered vehicle in Annex No. 1 to the SWZ (bidding form). Failure to enter data in the dotted places in the bidding form will result in the rejection of the offer based on Article 226(1)(5) of the Pzp Act – as non-compliant with the terms of the contract, if it cannot be determined from any document submitted with the offer within the deadline for submitting offers. The Purchaser requires the provision of a minimum warranty for individual elements specified in Annex No. 3 to the SWZ, Section VI, point 2. Offering a warranty period below the minimum will result in the rejection of the offer based on Article 226(1)(5) of the Pzp Act, as non-compliant with the terms of the contract. The warranty will be counted from the date of the protocol acceptance of the subject of the contract by the Purchaser. If the Contractor offers a warranty higher than the minimum specified in Annex No. 3 to the SWZ, Section VI, point 2, the Purchaser will enter the offered warranty period in the bidding form. The warranty will be counted from the date of the protocol acceptance of the subject of the contract by the Purchaser. The Purchaser requires that repairs within the offered warranty be carried out at authorised service stations. The Purchaser demands the indication in the bidding form of an authorised service station for the offered vehicle make (at least one in the Silesian Voivodeship). The Purchaser demands that the delivered vehicle has a zero-mileage inspection carried out by the Contractor and at their cost, which must be confirmed in the vehicle documentation. The Purchaser requires that during the warranty period, all costs related to warranty service, including transport, be borne by the Contractor. The Purchaser requires that the complete vehicle, which is the subject of the contract, be delivered within the deadline specified in Section V of the SWZ. The Purchaser demands that the delivered vehicle has a fuel level above the reserve (the fuel reserve warning light must not be on). In the event of delivery of the subject of the contract with fuel at the reserve level or below, the Contractor will refuel the required amount of fuel at the place of delivery, at their own cost. The Purchaser does not consent to the change of the delivered vehicle to one other than that offered in the bidding form constituting Annex No. 1 to the SWZ, with the reservation as follows: In cases where the Contractor proves that the vehicle offered by them has been withdrawn from sale or its production has been discontinued or there is no access to it on the Polish market (confirmed by the manufacturer or trade representative for the Polish market). The Purchaser allows the possibility of offering and delivering another vehicle provided that its technical parameters meet the terms of the contract indicated in the description of the subject of the contract, and the price is not higher than that offered in the bidding form. In the above-mentioned case, the Contractor must obtain the consent of the Purchaser to change the offered vehicle. The Purchaser has the right not to consent to the change of the offered vehicle if the Contractor does not prove that the offered vehicle has been withdrawn from sale or its production has been discontinued or there is no access to it on the Polish market. In this case, the Contractor will be obliged to deliver the offered vehicle in accordance with the content of the offer. The Purchaser will communicate their consent or lack thereof in writing to the Contractor. In the event that during the validity of the contract the Contractor proves that the vehicle offered by them has been withdrawn from sale or its production has been discontinued or there is no access to it on the Polish market (confirmed by the manufacturer or trade representative for the Polish market), and the technical parameters of the new vehicle meet the terms of the contract indicated in the description of the subject of the contract, but according to the evaluation criteria (Section XX of the SWZ) the Contractor's offer no longer has the status of the most advantageous, the Purchaser will consider that the Contractor does not have the possibility of executing the contract based on the concluded contract and will withdraw from the contract with effect for the future without charging contractual penalties. In the event that during the validity of the contract the Contractor proves that the vehicle offered by them has been withdrawn from sale or its production has been discontinued or there is no access to it on the Polish market (confirmed by the manufacturer or trade representative for the Polish market), and the technical parameters of the new vehicle do not meet the minimum terms of the contract indicated in the description of the subject of the contract, the Purchaser will consider that the Contractor does not have the possibility of executing the contract based on the concluded contract and will withdraw from the contract with effect for the future without charging contractual penalties.
