Poland – Natural risks or hazards protection services – „Utrzymanie zbiorników wodnych na terenie Zarządu Zlewni w Piotrkowie Trybunalskim w latach 2027/2028”
Description
The subject of the contract is the maintenance and current servicing of water reservoirs in the area of operation of the Piotrków Trybunalski Water Management Board in the years 2027/2028 (removal of moss, monitoring and servicing, replenishment of prohibition signs and information boards, removal of blockages within the reservoir, etc.) – divided into 9 parts. 1.1 The detailed description of the subject of the contract includes Annexes from no. 1.1 to no. 1.9 (description of the subject of the contract for each part of the basic contract and the contract provided for in the right of option) SWZ, as well as Annexes from no. 2.1 to no. 2.9 (price offer form for each part of the contract). 1.2 The contract performed under the right of option in each part will consist of repeating the same activities as those provided for in the basic contract. 1.3 The contractor is responsible for carrying out the works in accordance with the contract and OPZ. During the performance of the works, the recommendations of the person designated to supervise the works, indicated by the Contracting Authority, must be followed. 1.4 Detailed descriptions of the subject of the contract, separated for each part of the contract, include Subject of Contract Descriptions (Annexes 1.1 – 1.9), Price Offer Forms (Annexes 2.1 – 2.9) and common contractual provisions for all parts (Annex no. 6). The descriptions of the subject of the contract have been prepared separately for each part, contain information on the detailed location, scope and conditions for the performance of the task together with map extracts indicating the locations of the individual tasks. 1.5 The offer price forms have been prepared separately for each part. 1.6 In accordance with Article 91(3) of the Pzp, the Contracting Authority informs that the Contractor may submit an offer in relation to a maximum of 5 parts of the contract. The Contracting Authority has determined the number of contract parts for which one contractor may submit an offer, in order to ensure that one and the same contractor will not perform the entire contract. In the event of an offer being submitted in relation to a greater number of parts than the limit set by the Contracting Authority, all partial offers will be rejected due to the inconsistency of the offer content with the contract conditions (Article 226(1)(5) of the Pzp). 1.7 Certificate. The subjective evidentiary means indicated in points 10.3 and 10.4 may be replaced by a valid certificate of the contractor of public contracts, as referred to in Article 124(2) of the Pzp, exclusively to the extent to which the certificate confirms the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure in the scope corresponding to the requirements specified in the SWZ. The certificate does not replace the subjective evidentiary means relating to the grounds for exclusion not covered by the certification, in particular Article 108(1)(6) of the Pzp, Article 5k of the Council (EU) Regulation No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229), Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting the support for the aggression on Ukraine and serving the protection of national security, as well as the circumstances that have arisen in the course of this procedure. The certificate replaces the subjective evidentiary means exclusively to the extent covered by the valid certification and indicated by the contractor in the declaration contained in Annex 2 to the SWZ. If the certificate covers only part of the grounds for exclusion or part of the condition for participation in the procedure, or confirms the fulfilment of the condition at a lower level than required in the SWZ, the contractor submits the subjective evidentiary means in the remaining scope. In the scope resulting from the valid certificate, the Contracting Authority does not require the contractor to provide other subjective evidentiary means, with the reservation of Article 124(4) of the Pzp and Article 31(6) of the Act on the certification of contractors of public contracts. In accordance with Article 125(1) of the Pzp, before selecting the most advantageous offer, the Contracting Authority will call upon the contractor whose offer has been most highly evaluated to submit, within a period not shorter than 10 days from the date of the call, current subjective evidentiary means indicated in point 10.5.1, to the extent to which they have not been replaced by a valid certificate of the contractor of public contracts, with regard to points 10.7.5–10.7.11 below. If it follows from the declaration (Annex 2 to the SWZ) that the contractor will use a certificate, and the contractor has provided the data required under Article 124 of the Pzp, the Contracting Authority will independently verify the certificate in the certification database and will not call upon the contractor to submit the subjective evidentiary means to the extent to which the circumstances required by the Contracting Authority result from that certificate. If the certificate does not cover all the circumstances required by the Contracting Authority, the Contracting Authority will call upon the contractor to submit the subjective evidentiary means exclusively to the extent not covered by the certification. If the data provided by the contractor do not allow for the location or verification of the certificate in the certification database, the Contracting Authority may call upon the contractor to submit, supplement, correct or explain those data in accordance with the provisions of Article 128(1) or (4) of the Pzp. If, despite the call, the Contracting Authority is unable to verify the certificate, the certificate will not be taken into account to the extent that it cannot be verified. If the data necessary to assess the circumstances confirmed by the certificate have not been disclosed in the certificate or in the certification database due to their legally protected nature, the Contracting Authority may require the contractor to make those data available or to obtain the consent of the certifying entity to make them available to the Contracting Authority, on the basis of
