SUBJECT OF THE CONTRACT

An Engineer as per Clause 3 of “Contract Conditions for Technological Equipment and Design – Construction for Electrical and Mechanical Installation Works and for Construction and Engineering Objects, Designed by the Contractor. General Conditions”. International Federation of Consulting Engineers (FIDIC), 1st ed., 1999, Edition in Bulgarian translation: Bulgarian Association of Architects and Engineering Consultants, as well as the relevant Specific Conditions, and also the Appendix to the Offer under the engineering contract; Technical control during the design under the design and construction (engineering) contract by preparing a report/ reports for assessing the compliance of the investment project for the above-mentioned object, with the requirements of the Employer; Assessment of compliance in terms of "Constructive" as per Art. 142, para. 10 of the SPA, where applicable; Construction supervision as per Art. 168 of the SPA; Coordinator “safety and health” for the construction stage for the object, mentioned at the beginning of these Specifications and in accordance with the conditions of the public procurement, specified in Section 1. The execution of the present order is in accordance with the above-mentioned. The contract covers the following services (which does not exclude the assignment of additional tasks in the process of executing the order in accordance with specific needs and specifics): Review, assessment of compliance with the contractual requirements and approval of the Programme of the Contractor; Review, assessment of compliance with the contractual requirements and approval of the revised (one or more) Programme of the Contractor; Control of the execution of the Programme of the Contractor; Review and opinion on the investment project prepared by the Contractor regarding its compliance with the Requirements of the Employer; Preparation of a comprehensive report for assessing the compliance of the investment project, as well as identical comprehensive reports during the execution of the construction, incl. assessment of compliance in terms of "Constructive" as per Art. 142, para. 10 of the SPA; Carrying out documentary and physical checks for compliance of the materials and equipment incorporated into the object up to the stage of their approval; Actions for reviewing and approving the insurances of the Contractor; Actions for reviewing and approving the guarantees of the Contractor, issued in connection with the performance of his contractual obligations; Actions for issuing decisions by the Engineer; Actions in the event of unforeseen physical conditions established by the Contractor; Actions of the Engineer in the event of non-performance by the Contractor of actions for environmental protection; Carrying out documentary and physical checks of the construction process; Issuing acts for interim payments, incl. the actions preceding them; Actions of the Engineer related to change procedures; Actions of the Engineer in relation to claims in accordance with the contract with the Contractor; Control over the preparation of acts and protocols during construction; Organising and conducting monthly progress meetings, incl. documenting the results thereof; Actions of the Engineer related to tests (individual and comprehensive – upon completion); Actions for issuing a Certificate of Acceptance of the Object; Actions for issuing a Certificate of Completion; Actions for performing the functions of a consultant/construction supervisor during the construction; Actions for performing the functions of a Safety and Health Coordinator during the construction. The services specified above are not exhaustive, as the Engineer is also engaged with all other obligations which are not explicitly mentioned, but arise from the provisions of the present contract and the provisions of the General and Specific Conditions of the engineering contract, where the relationships Employer – Contractor – Engineer are described in detail and cannot be repeated here without repeating the entire text of the contract conditions. For explicitly unregulated powers and competencies of the Contractor under the present contract in his capacity as an Engineer, the latter exercises his functions as they arise from the specific engineering contract conditions of the contract with the Contractor in case they do not contradict the applicable legislation. The Contractor under the present contract shall seek the written approval of the Employer before exercising his functions as an Engineer under FIDIC on matters for which the sanction of the Employer is explicitly provided for in the clauses of the contract with the Contractor of the engineering contract.
