The subject of the contract is the repair of sanitary changing rooms on the first floor of the gymnasium building of Szkoła podstawowa nr 2 z Oddziałami Dwujęzycznymi im. Aleksandry Piłsudskiej in Suwałki at ul. T. Kościuszki 126.

2. The detailed description of the subject of the contract specifies the scope of the work, the layout of the rooms, and photographic documentation, which are attachments to the SWZ.

3. All work must be carried out in accordance with the technical documentation and applicable technical conditions and regulations.

4. Pursuant to Article 101(4) of the Act, in cases where the subject of the contract is described using standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority allows equivalent solutions to those described. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent". The indication of the equivalence of the offered solution in accordance with Article 101(5) of the Act and on the basis specified therein, lies with the Contractor, in which case the Contractor is obliged to prove, by attaching the appropriate subject-matter evidence to the offer, as referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent.

5. In cases where trademarks have been used in the design documentation or technical specifications for the execution and acceptance of the work, this means that they are given as examples and only define the minimum expected quality parameters and the required standard. The Contractor may use equivalent materials or equipment, but with technical and quality parameters similar to or better than those, the use of which in no way negatively affects the proper functioning of the solutions adopted in the design documentation. The Contractor who uses equivalent equipment or materials will be obliged to demonstrate during the execution of the contract that the materials and equipment used by him meet the requirements specified by the Contracting Authority.

6. The use in the design documentation of the label indicates that the Contracting Authority accepts all labels confirming that the given construction works, supplies or services meet the equivalent requirements specified by the Contracting Authority label. In cases where the Contractor, for reasons beyond his control, cannot obtain the label specified by the Contracting Authority or an equivalent label, the Contracting Authority, within the time limit set by it, accepts other appropriate subject-matter evidence, in particular the manufacturer's documentation, provided that the given Contractor proves that the construction works, supplies or services, which are to be carried out by him, meet the requirements of the specified label or the requirements specified by the Contracting Authority.

7. The use in the design documentation of the requirement to have a certificate issued by a conformity assessment body or a report on tests carried out by that body as evidence confirming compliance with the requirements or features specified in the description of the subject of the contract, evaluation criteria for offers or conditions for the implementation of the contract means that the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. The Contracting Authority also accepts other appropriate means of evidence, in particular the manufacturer's technical documentation, in cases where a given Contractor does not have access to certificates or test reports, or the possibility of obtaining them within the appropriate time limit, provided that this lack of access cannot be attributed to the given Contractor and provided that the given Contractor proves that the construction works, supplies, services carried out by him meet the requirements or criteria specified in the description of the subject of the contract, evaluation criteria for offers or requirements related to the implementation of the contract.

8. If the description of the subject of the contract includes a provision resulting from the KNR or KNNR indicating the need to use specific equipment with specific parameters in the implementation of the contract, the Contracting Authority allows the use of other equipment provided that it ensures the achievement of the design parameters and does not pose a risk of non-compliance of the completed works with the technical documentation.

9. In the case of a description using standards, equivalent solutions are considered to be those that ensure compliance with the minimum requirements specified in the standard at a level not worse than described in the relevant standards. In the case of standards referred to in the SWZ (if not specified in detail), current standards are understood. In other cases (description of the subject of the contract using technical assessments, technical specifications and technical reference systems), an equivalent product, material or system is considered to be one with technical, functional and quality parameters not worse than those mentioned in the description of the subject of the contract.

10. The Contracting Authority informs that it is applying for co-financing from the Fund for the Development of Physical Culture within the programme Szatnia na medal – edition 2026.

11. The Contractor is obliged to manufacture and install an information board. The board should be made in accordance with the Guidelines on the fulfilment of information obligations of beneficiaries of programmes co-financed from the state budget or state special-purpose funds (available at: https://www.gov.pl/web/premier/promocja).

12. The Contractor is obliged to agree with the Contracting Authority the design and content of the board and the place of its installation.

13. The Contracting Authority informs that, in accordance with Article 257 of the Pzp Act, it may invalidate the procedure for awarding the contract if the public funds that the Contracting Authority intended to allocate for the financing of the whole or part of the contract are not granted to it (due to limitations, the full text in SWZ). Changes to the contract have been specified in attachment no. 9 to the SWZ (due to limitations, the full text in the attachment to the SWZ). The Contracting Authority informs that, in accordance with Article 139 of the Act, it may first carry out an examination and evaluation of offers and then carry out the subject qualification of the Contractor whose offer was highest evaluated.
