Poland – Refuse and waste related services – Odbiór i zagospodarowanie odpadów komunalnych od właścicieli nieruchomości zamieszkałych położonych na terenie gminy Płońsk

The subject of the contract is the service entitled: Collection and disposal of municipal waste from owners of residential properties located in the municipality of Płońsk. The contract will be executed no earlier than the period from 01.01.2027 to 31.12.2027. 2. The detailed description of the service implementation is Annex No. 11 to this SWZ. 3. The contracting authority, in accordance with art. 441.1 of the Public Procurement Law, has provided for the use of an option in the contract. 1) The contract specifies the maximum amount of waste that the contracting authority intends to transfer during the contract period as 3 671 Mg, with the minimum mass of waste during the contract period being 2 937 Mg, and the additional mass of waste provided for under the option being 734 Mg. 2) Under the subject of the contract, the contracting authority is entitled to exercise the option right in accordance with the rules and procedures described below. 3) Orders placed under the option are a unilateral right of the contracting authority, therefore the contracting authority's failure to exercise the option right will not constitute a basis for the contractor to claim any rights against the contracting authority. 4) The contractor will be obliged to execute the order subject to the option right after receiving prior notification from the contracting authority that it intends to exercise the option right. 5) The rules governing the execution of the order subject to the option right will be the same as those applicable to the execution of the basic order. 6) The contracting authority will exercise the option when: a) during the term of the basic agreement (12 months) the limit of the minimum mass of waste specified above is exhausted or b) the term of the basic agreement (12 months) expires – the contracting authority will exercise the option right for a period not exceeding 9 consecutive months. 7) The exercise of the option will not affect the content of the concluded agreement.
